Sunny Isles Beach

 Sunny Isles Beach is a city located on barrier island, Florida. It was developed as a vacation destination around year 1920. After the construction of Haulover Bridge and Biscayne Bay, Sunny Isles became accessible from other parts of town such as Miami Beach and Fort Lauderdale. Many canals, islands and peninsulas gave Sunny Isles the look of Venice in America. This led to development of Luxury Beachfront Homes and Condominiums.

 After the construction of a few small hotels such as Golden Strand many celebrities had enjoyed the beautiful beaches of Sunny Isles. Famous Rascal House deli also called Sunny Isles as it’s home.

Golden Shores community started around 1950 where houses were built on the shores of the intracoastal canal located on the north east corner of Sunny Isles Beach. A few two story motels started lining up along the beach of Sunny Isles. A pier also was built. It is still one of many destinations for visitors of Sunny Isles Beach. It has a fishing platform and a sea food restaurant.

Since the end of 1990′s many changes have been taken place in Sunny Isles Real Estate. The small hotels that stood on the beaches of Sunny Isles have been demolished and replaced by Luxury Sunny Isles Condos and Condo Hotels. How Secure Is Your Mexico Real Estate Investment?

All too often citizens of the United States, Canada and other countries ASSUME that property purchases are carried out automatically in Mexico in a manner similar to that of their native countries.  The first law of property purchase in Mexico is DON`T ASSUME anything!  Purchasing property is NOT  the same as in other parts of the world.

Would You Purchase a Property in Your Hometown Which Is Not Registered in the Local Public Registry or Land Titles Office?

Would you hand a complete stranger, without an office or an established business entity, a check for perhaps hundreds of thousands of dollars to pay for a property?  Why do so many foreigners do this when they purchase in Mexico?  Many do not realize that Mexico has a complex and complete legal system and a court system that is as well organized as any that exists in the United States, Canada or Europe.  It is essential that you have an idea of how the system works and what to expect when considering a purchase of property in Mexico.

Donâ??t Leave Your Brain at the Border!

Article 27 of the Mexican Constitution prohibits ownership by a foreign individual or business entity of real property (real estate) within the â??restrictedâ? zone which is an strip of approximately 30 miles from any coastline and 60 miles from any border.  Recognizing the demand by foreigners for ownership of property and recognizing the importance of making desirable properties available to foreigners for potential positive impact on the economy, the Mexican government implemented a series of Foreign Investment Laws beginning in 1973.  The law was modified in 1989 and again in December 1993, to incorporate the provisions of the NAFTA treaty passed in late 1993.

For those who are acquiring property for residential usage, the law requires that title to the property in the restricted zone be transferred to a Mexican bank, as trustee, in the establishment of a trust (fideicomiso) in which the foreigner is the beneficiary.  The bank is the titleholder of the real property and the foreigner is the owner of the rights of usage of the property.  The bank owns the real property rights and the beneficiary owns the personal rights of usage.  Ownership of these personal rights is evidenced through a deed prepared by a Mexican Notary Public and signed by a representative of the trustee bank.

Currently the term for a trust is fifty years.  The Foreign Investment Law of 1989 provides for renewal by filing an application.  Multiple renewals are permitted under the law.  By requesting extensions every fifty years, a property may be controlled by a family or business entity for generations.  For those foreign individuals or companies buying property in the interior of the country, not in the restricted zone, no bank trust is required but authorization from the Secretary of Foreign Relations must be obtained and ownership must be registered in the National Foreign Investment Registry located in Mexico City, as well as in the municipality where the property is located.

Avoid Mexico Taxes and Extra Costs. Leave the Mexico Deed in the Sellerâ??s Name:  This is Wrong!

Until the buyer is formally named as the owner in fee simple or in the bank trust in a public document before a Mexican Notary Public, title to the rights in the property remain with the persons named in the previous property deed.  Their signatures are required to transfer title.  If the buyer fails to obtain his or her own deed he/she will be required to obtain the titleholderâ??s signature before a sale and transfer to another buyer.  This can be costly, frustrating, dangerous and time consuming.

The Importance of Mexico Registration of the Deed for Beneficial Rights.

The Mexico purchase/sale document signed by buyer and seller is generally legally valid between the parties to a transaction.  It most likely contains the description of the property, the price to be paid to the seller, and any other special terms and conditions.  It WILL NOT, however, provide valid notice to third parties unless it is recorded in the Public Registry Office of the municipality in which the property is located.  Mexicoâ??s land registry system functions in much the same manner as the Public Registry offices in Podunk, North Dakota, Los Angeles, California, Ottawa, Canada or places in between.

many foreigners purchasing property in Mexico do not understand the importance of registration of their interest in property.  They believe that it should be left in the name of the property developer, in the Master Trust, or in the name of the previous holder of title.  What if the developer goes bankrupt?  What if the corporation and its principals, disappear?  Who can sign as the representative of the property?  Who then owns the property?  What happens if an unscrupulous seller sells the property to someone else?  While title is in the name of the seller, it is HIS/HER asset;  she may mortgage it, he may sell it again, it may be attached in satisfaction of a judgment, she may die without a will.

Unless the Deed for the rights of the Beneficiary has been Recorded, there may not be a remedy for the purchaser who neglected to obtain a registered deedâ?¦his or her interest and investment, may be lost.

To obtain the deed an appraisal, a property tax certificate, and a no-liens certificate must be obtained.  Notarized bank instructions must also be obtained if property is in the â??restrictedâ? zone.  Sellerâ??s capital gains tax and Buyerâ??s acquisition tax must be paid.  The deed transferring rights to the buyer must be registered and stamped by both the tax office and the public registry.  If this process is not complete, the buyer is not fully protected.  The buyerâ??s ultimate protection is registration in the Public Registry office record, NOT the Notary Public or the trustee bank!

Financed Properties in Mexico

When property is sold with a down payment and the balance to be paid over a term of years, many sellers prefer to hold title to the rights in their name and transfer title to their rights only upon receipt of payment in full.  Meanwhile, however, the seller may die, may disappear, may bo bankrupt�again risky situations for the buyer.  the prudent buyer will insist upon a transfer of title and registration of a mortgage or pledge in which he gives his rights in the property as security for payment of the remaining purchase price.

In the event of default by the buyer, the seller must conduct a proceeding similar to a judicial foreclosure in the United States and Canada.  It is as troublesome as a foreclosure in any country in the world but notably more problematical.  The registered title and recorded pledge or mortgage provides the buyer a greater comfort level in his investment.  The lender also enjoys protection in having his loan recorded and will have an established legal proceeding to follow in the event of default by the buyer.

Cozumel Real Estate Updates in the News

The Cozumel real estate market is effected by several factors which include amongst many others,  hotel occupancy rates, the ecological environment of the island, and the cruise boats that visit the piers from this Mexican Caribbean island. Below are short updates on activities this past month that are effecting the island but also the Mexico real estate market as a whole.

During the Easter vacations, the hotel occupancy rates arrived to nearly 80%.  Currently the island has approximately 3,522 units in inventory for the hotel industry.  People comment that the world economic situation has reduced the normal rates but also pointed out that with the gain of the dollar against the peso, this has regained opportunities given the fact that tourists have more pesos to spend.  It is estimated that each hotel room guest spends approximately $100 usd while a cruise ship tourist spends nearly $80 usd.

Another update is in regards to the project of the recuperation of the beaches in Cancun, Playa del Carmen and the Cozumel Island.  The mayor of the municipality met withthe governor this month to advise that the island is not against the project of restoration of the beaches, but is searching for an alternative area where they plan to extract the sands.  The current project outlines an area on the norther part of Cozumel where they plan to dig up fresh sand.  The project calls for the restoration of 7 million cubic meters of sand to be sucked up from the ocean floor off of the island and blown back to the beaches throughout the cities of Quintana Roo.

The news that is on front page throughout many parts of the world is the virus outbreak called the swine flu.  Here on the island, and in the entire state of Quintana Roo, there have been no reports of anyone having been infected.  The federal government has been aggressive on their response and their actions to prevent further spread of this flu and have closed all schools throughout the entire country until May 6th.  Cruise ships coming to Cozumel have also been postponed for the immediate future until the federal Secretary of Health gives the green flag.  They expect the ports to be open if all goes well within 7 – 14 days.  At the same time, as the government has taken correct steps in the prevention of the spread of the virus, the local, state, and federal government are already preparing action plans and marketing campaigns to be initiated to support the re surge of the important tourist industries.

Project to give Cozumel Real Estate bigger beaches

A project to re-build several beaches in the Cozumel Real Estate area is scheduled to start in the middle of October.  On the island of Cozumel, which is a TOP Mexico Beachfront destination for real estate,  authorities plan to reconstruct approximately 1.5 km of beaches in different sites on the island, for which the project has allotted 131,000 cubic meters of sand.

Mexican authorities are investing 957 million pesos (70 million dollars) to recover a total of 16.8 miles of beaches in the Cancun, Playa del Carmen and Cozumel Real Estate areas.  The goal is to have beaches up to 40 meters wide, for which a total of 6.1 million cubic meters of sand will be needed.

To implement the project, the authorities have selected two sand banks known as “The Ollita” and “North Bank”, which will be dredged and the sand they collect will be deposited on beaches.  Additionally elaborate containment structures will be constructed with concrete to avoid losing the newly recovered sand.

On October 19th the extraction and pumping of sand with a huge dredger will start; the machine is currently located in the Port of Manzanillo on Mexico’s Pacific coast, but must cross the Panama Canal to arrive in Quintana Roo.

According to Chief Engineer of the Beach Restoration Project, Juan Carlos Espinal, the sand to be used on beaches “does not get hot in the sun, has a high density and is compatible with the existing sand.”

The works, which were initially announced in July this year, will begin in late October and will be conducted by the Mexican company Dragados, said a statement from the Trust for the Restoration, Recovery, Support and Maintenance of the Federal Zone Maritime Land state of Quintana Roo.

How the Canadian and American Media Unjustly & Negatively Affects Tourism, the Working Man’s Economy and Real Estate in Puerto Vallarta, Mexico

Living in Puerto Vallarta for over eight years; I have seen during that time how some of the media in the USA and Canada will pick up on anything negative that happens in Mexico.  They then glamorize it into a news release that makes people reading or viewing the reports, think that Mexico is a very undesirable place to visit or live. I have lived in what would be considered a relatively safe place in Canada, that being Edmonton, Alberta, for 31 years prior to moving to Puerto Vallarta. I can tell you that Edmonton is by far a more dangerous place to live than Puerto Vallarta.  It seems the media has a fascination for sensationalizing anything that occurs in Mexico and this reflects in the fact that Americans and Canadians are uncomfortable about visiting or retiring in Mexico.  Puerto Vallarta, in contrast, is a virtual Paradise.

Most recently; the combination of the Worldâ??s Financial Crisis, Swine Flu (HINI), corruption in the government and the negative publicity concerning the internal fight against the Drug lords have had an extremely bad economic effect on Mexico: an effect that is mostly unjustified.  This article will present a very different viewpoint for most parts of Mexico.  This is not to say that I believe there are areas in Mexico where I would not live while having the same freedoms and comfort in the safety as in Puerto Vallarta.  Having lived and worked in Puerto Vallarta as a business owner, realtor & architect for over eight years, I can attest to much of what I am about to report:

1. World Financial Crisis: Mexico and Puerto Vallarta are certainly affected in a very significant manner from this downturn.  The resale and pre-construction real estate market has not come to a standstill but is certainly down by perhaps 85 to 90% by volume from the previous year.  In the re-sale market, there are very good deals to be had on a hit and miss basis.   Most properties are owned in Puerto Vallarta without mortgages and the cost of maintaining a property here is very low compared to the USA and Canada.  If an Owner does not need the equity they have in a property, there is not a very significant financial drain by owning the property.  Effectively the deals are from those that have a property here and need the equity elsewhere, be it in Canada or the USA and are often deeply discounting prices to obtain the equity they require.  Other owners who are not in a financial pinch are simply riding out the economic downturn for good reason as they know the prices will rebound.  This is currently a Buyerâ??s market and for those properties that are selling, the sales prices are generally in the 2006 to 2007 market levels.  Since this a popular tourist and retirement destination, these people are being quite wise.  A few things to consider concerning owning property in Puerto Vallarta are:

a.       Property taxes are a mere fraction of what they are in the USA and Canada.  Currently in Puerto Vallarta, they are approximately 0.001 of the assessed tax value, which is generally lower than the market value.  In my opinion, this will probably remain so as, although the cities and governments in Mexico need capital for development, the majority of the Nationals are still poor and cannot afford to have the property taxes increase significantly and the governments know this. The government cannot simply impose large increases to a population that does not have the money to pay for these increases.  The result is a very significant benefit to a foreign owner as they also do not have to pay large property taxes and they can be relatively assured this will not change very quickly;

b.       Puerto Vallarta has not seen, outside of the few properties mentioned above, the deep devaluation of real estate values as has been seen in many parts of the USA.  There is good reason for this:

i. Puerto Vallarta is a very desirable location for a second home or even a place to retire to.  One can live here very economically. It has an ideal semi-tropical climate even in the summer for those that can take a little heat and humidity. This is much easier to take than the minus 35 winter weather in parts of Canada;

ii. Most owners know that Puerto Vallarta will recover rapidly as the world comes out of recession so unless they are themselves in a financial crisis, why should they offer deep discounts for selling their properties?

iii. Puerto Vallarta is one of the safest places to live in the world, has very good flight connections to many locations in both the USA and Canada, provides almost a guarantee as to what to expect in the weather, has wonderful medical and dental care, has a myriad of charitable options for foreigners to get involved in should they want to assist Mexicoâ??s developing nature and has so many options for lifestyle.

2.         The Drug War: There has been extreme negative publicity concerning the effective warfare between drug lord families trying to get control of this multi-billion dollar illegal business.  Locally in Puerto Vallarta, there were some Drug Families that tried to move into Vallarta.  The Federal and State Governments sent in the army and have made it very clear that Puerto Vallarta is a very significant tourist and foreign retirement community and they do not want to have the Drug Lord families playing havoc with that.  This action has put a pretty good lid on this problem.  Like any area, be it in the USA, Canada or Mexico, if one stays away from buying and participating in drug use, the area is extremely safe.  In my past life of 31 years in Edmonton, Alberta, where there are drive by shootings and gang related crimes I have found that this is virtually unheard of the Puerto Vallarta.  To give you a sense of what it is like to live here, please review the following:

a. I would not be concerned if my wife walked alone in most public areas of Puerto Vallarta, even in the middle of the night.  She owned a restaurant for two years and frequently left to come home at 2:00 in the morning without an escort and nothing ever concerned her.  In Edmonton, Alberta, I would not be comfortable with that even if both of us were together;

b. Most of the dangerous crime areas are around the Mexican/USA border which is the area that Hillary Clinton recently acknowledged that the USA is very connected to the cause of this problem.  In her statements she said  if it was not for the market for drugs in the USA, there would not be a problem with the smuggling of weapons and money from the USA to Mexico and conversely for the smuggling of drugs into the USA from Mexico.  This acknowledgement has paved the way, in my opinion, for both the Mexican and USA governments to work cooperatively to fix this problem;

In Puerto Vallarta, like in any city in North America, there is an illegal drug trafficking business and like most cities if you choose not to participate, you live generally unaware of the problem and have a peaceful life unaffected by the problem.  I have seen extremely unfair journalism concerning how bad Mexico is to visit while very little reporting is being done on the local problems that all cities have.  An example would be reporting on how a USA or Canadian was killed while out partying.  I look at this and realize how some tourists simply do not use common sense about how they party, where they party and how they act.  In any country one must keep a sense of courtesy toward the local people and use common sense concerning how they act.  Do the newsmakers report that when there is a brutal killing in Detroit that this should mean that people should avoid visiting the United States?  No!!! but that would be a good comparative to use.  The Canadian and USA news should report that it is a good idea to act civilly when you are a tourist in a foreign country, be it Mexico or Russia and keep your head about you so you will not get into trouble.  I have seen too many tourists come to Mexico and think they can treat the Nationals with disdain and without respect.  Mexicanâ??s are, for the most part, a very friendly people and are happy to assist tourists to have a good time.  Most tourists are wonderful, come to have a rest and a good time and accomplish this.  For those that are uncivil and get into trouble, where is the reporting on how tourists act and how they should act?   The reporting should be telling people to keep their heads when they travel, keep away from getting too drunk that you lose your senses and definitely stay away from getting involved with drugs.  Then you will most likely have a wonderful holiday.

3. Swine Flu: Another element that has crippled Mexicoâ??s economy recently is this flu which has created hysteria worldwide.  Mexico acted with incredible integrity for the world in that they reported the disease and made all sorts of closures of businesses and schools to help contain this potential Pandemic.  In the end, the flu has turned out to relatively minor with few deaths outside of Mexico and in reality about 100 deaths inside Mexico. This number represents cases when the disease was not known and people thinking it was only a common flu did not get treated on time. Major underlying chronic diseases also had a lot to do with the deaths.  The number of deaths has been reduced significantly over the last few days due to better information acquired and all the preventive measures taken by the Mexican government. The majority of infections in Mexico have taken place in Mexico City and central states with zero cases in most Pacific states including the city of Puerto Vallarta.  The international news now is â?¦.. wait until this flu virus mutates and comes back again with a vengeance in the fall!!!  How do they know this and what does it now have to do with Mexico.  This influenza virus is now all over the world and if it does mutate, it could mutate anywhere in the world.  I bet if you asked people about this, they still relate the potential problem to Mexico.  In all probability this may well again be a mild flu causing insignificant deaths compared to the annual death toll from influenza related diseases.  Unfortunately, the public perception will probably take time to waiver and Mexico will be unjustly punished in the meantime.

4. Government Corruption: Mexico is a developing nation, moving from the being a third world country to a developing nation and in time a fully developed industrial country.  Some of itsâ?? primary assets are people, wonderful tourist destinations, a very rich culture and a people who are mostly pleased to welcome and make the tourists and retirees comfortable in being here.  There is a history of corruption at all government levels and this will not be negated overnight.  There has been a tremendous improvement even in the eight plus years that I have been here.    Keep in mind also that this is a developing nation and is not as polished as the United States or Canada.  I donâ??t imagine that anyone in the USA and/or Canada could say that their governments do not have a lot of corruption as well but not as blatant.  This problem should not tarnish Mexico with regards to tourism or buying a piece of property.
